The following constitutes the Videography Agreement (the “Agreement”) of Jack Murphy Videography (the “Videographer”). Please read the Agreement in its entirety and contact the Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the signer of this Agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records. Initial that you understand the above.
It is understood that Jack Murphy Videography is the exclusive Videographer retained by the client to film the wedding. Any conflicts with other videography contracts are the sole responsibility of the client. Initial that you understood the above.
Client assumes all responsibilities for not obtaining any necessary permission, clearance permits, etc., which may be required for Jack Murphy Videography to film on location. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for problems resulting from the use of, or inability to use, such camera positions. Jack Murphy Videography will establish an arrival time for the wedding date with the client prior to that date and will remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive. Initial that you understood the above.
Jack Murphy Videography reserves the right to use media shot from the event for display and promotional purposes. All video masters, raw footage, and photographs remain the exclusive property of Jack Murphy Videography. Initial that you understood the above.
On its own behalf and on behalf of the subject: Client acknowledges that he/she is familiar with the Jack Murphy Videography’s portfolio and is requesting services with knowledge of the company’s style and that Jack Murphy Videography’s work is constantly evolving; that Jack Murphy Videography's services are of a unique and artistic nature; that the video may be different from videos done by the company in the past; and that in creating the videos the company shall use their own creative artistic judgment to create videos consistent with the company's personal judgment and consistent with their vision of the event. Accordingly, client acknowledges that the videos shall not be subject to rejection on the basis of taste or aesthetic criteria. Initial that you understand the above.
If Jack Murphy Videography fails to comply with the terms of this agreement due to any event at or beyond the control of Jack Murphy Videography, including but not limited to illness, accident, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Jack Murphy Videography’s liability is limited only to a refund of all payment received. The client reserves the right to terminate the contract for any reason up to 3 days after the date of down payment. It is understood that if the booking of Jack Murphy Videography's services are cancelled within 1 week of the event, the Client is liable to reimburse Jack Murphy Videography for 50% of the total contract value. It is also understood that if Jack Murphy Videography's services are cancelled within 48 hours of the event, the Client is liable to reimburse Jack Murphy Videography for 100% of the total contract value.
